Section 1 of Article 2 of the U.S. Constitution states that a President must:

  • be a natural born citizen of the united States
  • be at least 35 years old
  • have lived in the U.S. for at least 14 years

In addition, the 22nd Amendment to the U.S. Constitution states that a President may not serve more than 2 terms of 4 years each, even if they have only served as President for 2 or more years of one of those terms.

From the united states constitution:

No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United

States.

  • Only natural-born U.S. citizens (either born on US soil or born to at least one US citizen) may be President of the United States, though from time to time that requirement is called into question, most recently after Arnold Schwarzenegger, born in Austria, was elected governor of California, in 2003. The Constitution originally provided a small loophole to this provision: One needn't have been born in the United States but had to be a citizen at the time the Constitution was adopted.(this was not so much a loophole as necessary to elect presidents until one could be born a US citizen)
  • One must also be at least 35 years of age to be president. There is no maximum age limit set forth in the Constitution.
  • Finally, one must live in the United States for at least 14 years to be president

Can the vice president after serving 8 yrs with the president run with a new presidential candidate ie hillarybiden ticket?

yes, that would be legal The office of the U.S. Vice President has no bearing on the term limits of the President that were established in 1952 with the ratification of the 22nd Amendment to the U.S. Constitution. If someone were to serve five full terms as Vice President, for example, he/she would still be eligible to be elected President twice. The only way that the term limits affect the Vice Presidency is that the Constitution requires that in order to run for Vice President, one must be eligible to be President. Therefore, someone who has been elected President twice could not run for Vice President. (There are some who believe that the presidential eligibility requirements for the vice presidency are only the age, citizenship and residency requirements and that having been elected President twice does not prohibit someone from running for Vice President. The opportunity to settle the debate in the courts has never come up.)
