There have been only six amendments sent to the states for ratification that were not approved. Four of them had no expiration date. The other two did have expiration dates and have expired. These were the Equal Rights Amendment and the DC Voting Rights Amendment.

Five proposed Constitutional amendments have been passed by Congress but not ratified by the states. Three are still alive; the other two expired. With 50 states in the Union, at least 38 must ratify a proposed amendment for it to take effect. If/When we add a 51st state, the minimum number of states needed to ratify goes up to 39.

Twelve proposed amendments were passed by Congress on September 28, 1789. The third through twelfth were ratified on December 15, 1791, becomming the first through tenth Amendments, collectively known as the Bill of Rights. The second of the twelve, which prevents a Representative's or Senator's pay increase from taking effect during the same term in which it is passed, was ratified on May 5, 1992, becoming the 27th Amendment. The first of the twelve, the Congressional Apportionment Amendment, which would set the maximum size of a congressional district to 50,000, needs to be ratified by 27 more states before it can take effect. The only states that have ratified it so far are KY, MD, NH, NJ, NY, NC, PA, RI, SC, VT & VA. The average size of a congressional district today is over 700,000, and the largest congressional district, Montana At Large, has over a million people.

The Corwin Amendment, which would prohibit any subsequent amendment that would abolish or interfere with the domestic institutions within any state, was passed by Congress on March 2, 1861. Its propose at that time was to prevent the ratification of a constitutional amendment that would make slavery unconstitutional. To date three states have ratified it: IL, MD & OH.

The Child Labor Amendment, which would give Congress the power to regulate the labor of everyone under 18, was passed by Congress on June 2, 1924. To date only 28 states have ratified it: AR, AZ, CA, CO, ID, IL, IN, IA, KS, KY, ME, MI, MN, MT, NV, NH, NJ, NM, ND, OH, OK, OR, PA, UT, WA, WV, WI & WY.

The Equal Rights Amendment, which would have prohibited sexual discrimination, was passed by Congress on March 22, 1972. 35 states ratified it before it expired on March 22, 1979. Congress passed an extention to the ratification deadline, which expired on June 30, 1982 with still only 35 states having ratified it.

The D.C. Voting Rights Amendment, which would have given D.C. voting membership in both houses of Congress, was passed by Congress on August 22, 1978. 16 states ratified it before it expired on August 22, 1985.
