Born April 20, 1920, the 90-year-old Justice John Paul Stevens was the Senior Associate Justice on the Court, and had served under three Chief Justices (Warren E. Burger, William H. Rehnquist, and John G. Roberts).

Kennedy is considered the "swing vote" on the Court because his conservative ideology is tempered by strong support for individual rights, such as privacy.
