Because the colonies lacked elected representation in the governing British Parliament, many colonists considered the laws to be illegitimate and a violation of their rights as Englishmen. In 1772, groups of colonists began to create Committees of Correspondence, which would lead to their own Provincial Congresses in most of the colonies.

By May 1776, 8 colonies had decided to support independence. On July 2, 1776, the resolution for independence was adopted by 12 of the 13 colonies, w/ NY not voting. It was made official on July 4, 1776; on July 9 the NY convention finally approved.

I think you are confused. The Declaration came before the war and was the basic cause of the war. As far as the king was concerned the 44 men who signed the Declaration were traitors to the crown. Ben Franklin stated, as he signed, " that they all will hang together or hang separately ".
