Yes, an amendment to the U.S. Constitution can be ratified if three-fourths of the state legislatures vote in favor of it. This means that out of the 50 states, at least 38 must approve the amendment. Alternatively, an amendment can also be ratified by conventions in three-fourths of the states, but this method has never been used.
As of now, the Equal Rights Amendment (ERA) has not been ratified by five states: Alabama, Arizona, Arkansas, Florida, and Georgia. These states either rescinded their ratification or did not approve the amendment during the initial voting period. Additionally, while some states have ratified the ERA, there has been ongoing debate about the amendment's finality and the validity of rescissions.
