James Otis was an American political activist born in Massachusetts on February 5, 1725. He was influential in the period leading up to the Revolutionary War, particularly throughout the 1760s when he helped the colonists express their grievances and complaints against the British government.
James Otis was a lawyer, who was hired by a group of merchants in 1760. This came about from the British officials who wanted to put a clamp on smuggling. Customs officials would obtain written court orders called "writs of assistance." This enabled the officials to conduct general searches, without stating in advance what they were looking for.
James Otis argued on behalf of the merchants, that the writs violated the colonists' rights, among which was the right to privacy. Otis lost the case, but his brilliant argument would long be remembered.
