The Budget and Accounting Act of 1921 requires the President of the United States to submit his budget request to Congress for the following fiscal year. Current law (31 U.S.C. § 1105) requires the president to submit a budget no earlier than the first Monday in January, and no later than the first Monday in February. Typically, presidents submit budgets on the first Monday in February. The budget submission has been delayed, however, in some new presidents' first year when the previous president belonged to a different party.

In the US, the budget is produced by the House of Representatives, and must also be passed by the Senate. It is not submitted by the President, although the President does have the opportunity to either sign or veto the budget once it has been produced by Congress.

Article 1, Section 7 states:

Bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with amendments as on other Bills.

Article I, section 9, clause 7 states:

No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law; and a regular Statement and Account of the Receipts and Expenditures of all public Money shall be published from time to time.

This is pretty much all the Constitution has to say about the budget. The President is not required by the Constitution to submit a budget - however - the Budget and Accounting Act of 1921 requires the President of the United States to submit his budget request to Congress for the following fiscal year .
