Certain slightly twisted readings of the law might allow David Rice Atchison to be counted; James Polk's term of office expired on Sunday, and incoming president Zachary Taylor did not wish to be sworn in on Sunday, so by some interpretations David Rice Atchison, who was President Pro Tempore of the Senate, should have been President of the United States during the interim before Taylor was sworn in as President on Monday. There are several flaws with this theory (most notably that Atchison's previous term as President Pro Tem had also expired, and he also hadn't been sworn into his new term yet, putting him in the same position as Taylor), but it's a good story, particularly since Atchison spent the entire day in bed with strict instructions that he was not to be woken. (He was woken late that night by fellow senator Willie Mangum who jokingly asked to be appointed Secretary of State; Atchison himself never claimed to be President, but later made a joke himself that at least he could boast that no one had suffered due to his actions during his term.)
