Confederate General Robert E. Lee could have stayed in the US Army for a few reasons. The first one was that he opposed session. In addition to that, Lee already had taken an oath as a US Army officer, and wanted to keep his pledge intact. This decision would have hurt his home state of Virginia, and it's certain he could have refrained from combat action against Virginia by asking for example, for a teaching post back at West Point. He already had served there as the Academy's superintendent. He would of course had to take his wife north and most likely could not have returned to Virginia. There's an excellent chance that after the war, his property in Arlington Virginia would have been purchased by the Federal government, instead of having it confiscated, which did happen because he served the Confederacy,
Lee's appointment as commander of the Army of Northern Virginia put him in a position to thwart the offensives of the Army of the Potomac until April of 1865 by using an aggressive elastic defense by the use of forestalling or spoiling attacks by which he attacked his attackers before they could attack him. His house was at Alexandria, Virginia, and it could be seen from the roof of the White House - a vivid reminder that this was a war between neighbours. But of course, he was seldom there. He was travelling with the Army of Northern Virginia.
