The incursion by the U.S. Army, who did the initial survey that started the rush to the area, was an unofficial violation of those treaties. They were supposed to be surveying a route for a rail line, the men started prospecting on their own time, found some gold, and word leaked out. Oddly coincidental, there was a major recession going on at the time, and suddenly, there's a new gold strike in the west.
