Basically they are a person non related to the defendant or the respondent and have a biased opinion and have to here both sides to come to their decision and all jurors have to come to one decision before a judgment can be made in either direction. Jurors are responsible for finding the facts. The Judge is responsible for the findings of law and that the rules of law are followed. The alternative to a trial by jury is to have the Judge determine both the findings of law and the findings of fact. By saying that a jury trial is always an option, it allows people to avoid what may be a biased legal system, getting citizens to hear the case rather than a jaded or appointed judge from slanting the case one way or another. And a jury trial in a civil case can be expensive.
