Ratified June 15,1804

Changed the way the President and Vice President are elected.

The 12th Amendment means:

- separate ballots are used for president and vice president.

- the candidates with the greatest number of votes for each office will be elected if that number constitutes a majority of the total electors.

- if a majority for the president is lacking, the House of Representatives shall vote by state from among the three highest candidates.

- if a majority for the vice president is lacking, the Senate shall vote by state from among the two highest candidates

- the vice president must meet the same constitutional requirements as provided for the president.

Whereas, the initial procedure allowed electors to vote for two presidential candidates, the Twelfth Amendment required the electors to cast votes for the president and vice presidential categories.

This amendment gave the electors in the electoral one vote to vote once for the pair that are running for president and vice-president. Therefore, the president and vice-president are from the same party and the winning president knows who his vice-president will be.

Before this amendment, each elector had two votes for president and and the man who finished second was made vice-president. This plan caused two problems. In 1796. John Adams won the presidency and his bitter opponent, Thomas Jefferson, was made vice-president. In 1800, Thomas Jefferson ran for President, with Aaron Burr his running mate. However all of the supporters of Jefferson also voted for Burr, so there was a tie. Burr saw his chance to be President and so did not resign, throwing the election into the House to be decided. There was a long debate, deals were proposed and made, and eventually Jefferson was declared the winner.
