When a US president is up for impeachment, the House of Representatives must decide if enough evidence has been gathered to proceed forward. If so, then a trial is held before the US Senate who will decide if they will impeach or not.

In a court of law, the final decision is typically made by the judge if it is a bench trial (no jury). In cases with a jury, the final decision is made collectively by the jury based on the evidence presented and the law as instructed by the judge.

"The President, Vice President and all civil officers of the United States, shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors." (It's in the constitution, article II, section 4).

Yes. If the President is being tried for impeachment in the Senate, the Chief Justice of the United States (Supreme Court) presides over his (or her) trial. For all other impeachment trials, a committee presides over the trial, but the President of the Senate (US Vice-President), or someone he or she designates, makes decision about points of procedure.

Executive privilege should not be eliminated. It is legal for the President of the United States to use executive privilege where the President makes the final decision as the President feels would be best. It has been used many, many times.
