The US needs the Supreme Court to help with the system of checks and balances. The Supreme court interprets the laws. The supreme court also takes care of cases that cannot be settled in the lower courts.

We need a Court that is the ultimate authority on the Constitution, which controls all laws in the US. The Supreme Court plays an important role in the way our government functions: they are responsible for upholding the Bill of Rights and for checking the power of the Executive and Legislative branches.

On a more practical note, it was necessary to make one body the ultimate authority on federal and constitutional law and treaties to establish uniform interpretation of the laws so the federal court system would make consistent decisions. This intentionally differentiated American common law from English common law in that the English system of that time allowed each court to set its own precedents, creating a situation where laws could be applied differently or unfairly, depending on where a person was tried. The Supreme Court helps ensure all federal courts follow the same interpretation of law, in order to make the application of both procedural and substantive due process the same for everyone.
