During the Republic Roman law was based on mos maiourm (the way of the ancestors, ancestral customs). In other words, it was a customary law. It was also a common law in that it was based on precedent. During the period of rule by emperors, laws were imperial edicts and therefore depended on the policies of the emperor. In the Late Republic and in the early part of rule by emperors, stoic philosophy had a degree of influence on Roman jurists.
