Constitution is Supreme Law of the Land over State laws. But only for laws explicitly stated in the Constitution. E.g. States can't print money. I think it also says the states own the citizens... but not sure any citizen agreed to this. Various theories exist that if you register to vote or do other things that you have agreed to the laws of the state. Certainly this is true with agreeing to servitude to the county if you live in NC if you buy property. Read the contract. Similarly, cities in NC must agree to levy property tax. So, its a property tax based system. Now, can an HOA make a law superceding a state law? I don't think so. I think the existence of the law enforcement and court systems mean whatever law they enforce is the supreme law of the land. Of course, the IRS is absolved of normal courts and has its own; so one might think they are their own super supreme. My research thus far.

The Constitution.
The US Constitution is called The Supreme Law of the Land.
The Supreme Court Justices interpret and enforce the US Constitution. The US Constitution is the ultimate "Law of the Land", to which they are bound.
Article VI of the US Constitution states, in part: "This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land..." All laws, federal or state, must conform to the Constitution.
I know that the right answer is the US constitution.

Yes, US District Courts can, and do, declare laws unconstitutional. Any court can declare a law unconstitutional if the law is relevant to a case they're trying or reviewing; however, the government would probably appeal the case all the way to the Supreme Court to get a definitive answer. The US Supreme Court is the ultimate arbiter of constitutionality, and has final authority over questions of constitutionality.
